The current rule
India’s blood-donation guidance asks men who have sex with men (MSM) to defer donation — an indefinite deferral, with a court decision on the policy pending. The rule is a blanket deferral inherited from an era when HIV risk was mapped to identity groups instead of individual behaviour. Screening at most Indian centres still applies it.
For context: much of the world has already moved on. The UK (2021), the US (2023), Canada (2022), Germany, France, Italy, Israel and others have scrapped orientation-based deferrals entirely, replacing them with individual risk questions asked of every donor — recent partners, unprotected sex, new relationships — regardless of gender. Bhutan, our neighbour, has no deferral either. India remains on the restrictive side of that map, and the policy is under legal challenge.
What the science says now
Modern transfusion medicine in several countries (including the UK and US) has moved to individual risk-based screening — asking every donor about recent partners, unprotected sex and new partnerships, regardless of gender or orientation. A monogamous gay man and a monogamous straight man carry the same risk profile; a person with multiple recent unprotected partners carries more risk, whatever their orientation. The deferral-by-identity model predates this science.
What honesty requires — from both sides
- If the rule applies at your centre, do not donate under a false answer. Every unit is laboratory-tested for HIV and hepatitis, but the deferral is current policy, and breaking it undermines a screening system that depends on truth.
- Centres and regulators are the ones who can modernise the rule. Public health bodies internationally have shown the path: same questions for every donor, risk assessed by behaviour.
